On 23 August 2010 Tractionel Enterprise obtained interdictory relief from the High Court of South Africa against Adv. Matane Mphahlele restraining him inter alia from:

·         Performing or purporting to perform any act(s) as director for Tractionel Enterprise

·         Performing or purporting to perform any act(s) as shareholder of Tractionel Enterprise

·         Interfering with the contractual relationship between Tractionel Enterprise and its clients, with special emphasis on the Gautrain Project.

On 25 July 2010, the Sunday Times published an article on the front page of their business section under the heading “Gautrain Company “hijacked” at Cipro.”  The article is considered to be a factual presentation.
